3. YOUR DATA PROTECTION RIGHTS

Under data protection law, you have rights in relation to your personal information. You can find out about the scope of these rights on the Information Commissioner’s Office’s website: ico.org.uk.

Your right of access

You have the right to ask us for copies of your personal information.

Your right to get your data corrected

You have the right to ask us to correct your information if you do not think it is accurate. You can also ask us to complete information you think is incomplete.

Your right to get your data deleted

You have the right to ask us to erase your personal information, and in certain circumstances we may need to delete it. For example, where we need your consent to use your information or when our purpose for using your information has come to an end.

Your right to limit how we use your data

You have the right to ask us to limit our use of your information temporarily. For example, if you believe your information is incorrect, you may ask us to restrict its use until we rectify it.

Your right to object to processing

You have the right to object to our use of your personal data. This may mean we stop sending you marketing communications. 

Your right to data portability

You have the right to ask that we send the information you give us to another organisation. This only applies if you have given us consent to process your information or if you are in talks about entering a contract and the processing is automated.

Your right not be subject to automated decision making

We may use your personal information for profiling. This will be to:

  • create greater consistency and fairness in our decision making process

  • reduce the risk of customers failing to meet payments for products or services

  • assess risk, and

  • comply with our legal obligations in respect of fraud prevention or money laundering.

Sometimes the MOR may need to use profiling to enter a contract or deliver services to you. If profiling is not necessary for these reasons, you can object to it. You can ask to be excluded from decisions based solely on profiling or other automated decisions which could impact you.

4. YOUR RESPONSIBILITY TO PROVIDE ACCURATE INFORMATION

It is important that any information you give us is accurate and correct. Please let us know as soon as you can if any of your information is incorrect or out of date.

The MOR is a UK-based company. Your personal information is managed on our administration systems and databases.
If we need to transfer your personal information to a country outside of the UK or EEA, we will make sure appropriate safeguards are in place.

For each different purpose for which we use your data, we need to have a lawful basis. The different lawful bases are set out in the UK Data Protection regulation and the General Data Protection Regulation. The ones we’re relying on are:

  • Consent: We rely on this basis to give you choice where you may not usually expect your information to be recorded. This legal basis is set out in article 6(1)(a) of the UK Data Protection regulation and the General Data Protection Regulation.

  • Performance of contract: We rely on this basis when our use of your data is necessary for the performance of the contract between you and MOR and to take steps at your request prior to entering into the contract. This legal basis is set out in article 6(1)(b) of the UK Data Protection regulation and the General Data Protection Regulation.

  • Legitimate interest: We rely on this basis when our use of your data is necessary for the purposes of our legitimate interest which does not unduly impact you rights and freedoms. This legal basis is set out in article 6(1)(f) of the UK Data Protection regulation and the General Data Protection Regulation.

  • Legal obligations: We rely on this basis when we have a legal obligation to use your data in a certain way. This legal basis is set out in article 6(1)(c) of the UK Data Protection regulation and the General Data Protection Regulation.

We may also collect and process special category data where you disclose a vulnerability to us. A vulnerable customer is someone who, due to their personal circumstances, is especially susceptible to harm - particularly when a firm is not acting with appropriate levels of care. Any data pertaining to customer vulnerabilities will be processed with consent to understand the needs of the customer and ensure we respond to those appropriately.

  • From you: The personal information which we use is typically provided by you directly to us.

  • Our members and applicants for our products may provide us with personal information about other persons. If you provide us with any information about other individuals, please inform them beforehand and direct them to this privacy notice.

  • Third party intermediaries, brokers and third parties who are authorised to introduce or sell our products and services who provide us with the information necessary to process any applications or requests for products or services.

  • Information Commissioner’s Office, law enforcement agencies and other public bodies may provide us with information about individuals who have made a complaint or in relation to their investigations and law enforcement activities.

We also use this information to improve our website experience.

Telling people their membership is coming to an end: Where we provide membership, we may send a few letters/emails to inform individuals that their membership is ending and to offer them ongoing membership

Marketing to our members: We have a legitimate interest to send marketing to people who’ve purchased an MOR product or service (unless they’ve specifically asked us not to).

• Our partners: Where we provide a service to you through your relationship with one of our partners, our partner will provide us with your information.

• Data services providers, such as data service organisations, who collect demographic data and publicly available information which is used to help us improve and tailor our products and services or information used to identify products and services that we believe you may be interested in.

We will use email, telephone, SMS, post and social media i.e. Facebook or Google to inform you about these products and services.

Android

You can reset your advertising ID in your mobile device’s settings. Resetting your advertising ID erases all data previously associated with it, meaning you will no longer receive personalised adverts.

  • Open Google Settings

  • Go to 'Privacy > Ads'

  • Tap on 'Reset Advertising ID'

  • Confirm the reset

iOS

You can turn off personalised ads which use your advertiser ID in your mobile device's settings. Turning off personalised ads will reduce the number of relevant ads to you but will not reduce the number of ads you receive.

  • Open Settings

  • Go to 'Privacy & Security'

  • Tap on 'Apple Advertising'

  • Toggle off 'Personalised Ads'

Your rights relating to marketing
